The court in U.S. v. Santos, 363 F.3d 19 C.A.1 (Mass.), (2004) noted that the Massachusetts assault and battery statute covers two separate crimes, one involving actual or potential physical harm and the other involving a nonconsensual, but non-harmful touching.
